Terms of Participation — Smart Women Don’t Diet Program

This Program Agreement governs participation in the Smart Women Don’t Diet Program operated by Ginny Trierweiler Consulting, LLC (“Company”).

This program was created and is guided by Dr. Ginny Trierweiler. Questions regarding this agreement may be directed to drginnyt@gmail.com

COACHING FORMAT AND FEES

1. Client receives the Smart Women Don’t Diet program, including:

– 4 core modules with video lessons covering why weight loss diets do not tend to work for lasting weight loss, and what does.
– The course workbook
– Invitation to apply for a complimentary call upon completion

2. The Program Term: The core Smart Women Don’t Diet program is designed to be completed over approximately four weeks. Access duration and pacing may vary depending on program updates or participant engagement.

3. Rollover Credit Option: If Participant chooses to continue into another SimplyWise program within 45 days of this Agreement, the full investment will be credited toward the tuition for the next program.

4. Program Fit: Smart Women Don’t Diet is an educational program. It may not be appropriate for individuals with an active eating disorder or a serious mental illness requiring clinical treatment. Participants are encouraged to consult with their healthcare or mental health provider if they are unsure whether this program is appropriate for them.

AGREEMENTS

5. Intellectual Property: All course content remains the property of Ginny Trierweiler Consulting, LLC. Participant agrees not to copy, share, or distribute materials. Access is granted as long as the hosting platform is maintained.

6. Coaching, Education, and the Role of a Coach:

– The Smart Women Don’t Diet Program is an educational and coaching program designed to support personal and health goals. It is not psychotherapy, medical treatment, nutritional counseling, or any other form of clinical treatment.
– Dr. Trierweiler is a licensed psychologist who is providing coaching and education in this program, not psychological or therapeutic services. Participants understand that information provided is educational in nature and not a substitute for medical or mental health care.
– A coach acts as a mentor and guide; participants retain full responsibility for their choices and well-being.
– Confidentiality: While confidentiality is respected within the program, coaching is not a legally protected or privileged relationship. Ginny Trierweiler Consulting, LLC, under the professional oversight of Dr. Ginny Trierweiler, must report suspected abuse or imminent danger and may be required to share information pursuant to court order or other legal obligation.

7. Release of Liability: Participant releases Company and Dr. Trierweiler from any and all liability, damages, and claims related to participation in the Program, except in cases of gross negligence.

8. Disputes: Disputes must first be submitted in writing with supporting documentation. If unresolved, both parties agree to non-binding mediation in Boulder, Colorado, with mediator Steve Clymer of Accord Dispute Resolution. No legal action may be taken before mediation.

9. Legal Venue and Fees: Legal actions will be brought exclusively in Boulder County, Colorado. Both parties waive the right to jury trial. The losing party in any legal action shall cover reasonable attorney’s fees and court costs.

10. No Guarantees or Refunds: Results vary by individual, and no specific outcomes are guaranteed. All sales are final once access to the Smart Women Don’t Diet program has been provided. Refunds or alternative arrangements may be offered, at the sole discretion of Company, only in cases where participation in the program is determined to be inappropriate due to circumstances disclosed after enrollment. The provision of any refund or alternative arrangement does not constitute a waiver of this policy for future participants.

11. Liability Limitation: Company’s total liability is limited to the amount paid by Participant under this Agreement.

12. Entire Agreement: This document reflects the full agreement between Participant and Company/Dr. Trierweiler and supersedes prior discussions. Changes must be made in writing and communicated to participants.

13. Acknowledgement and Acceptance: By enrolling in and participating in the Smart Women Don’t Diet Program, the participant acknowledges that they have read, understood, and agreed to the terms outlined in this Program Agreement as of the date of purchase.
